J&J Will Appeal Texas Two-Step Strategy to Supreme Court

J&J Logo

In the ongoing legal battle involving Johnson & Johnson’s use of the much-criticized Texas Two-Step, J&J now plans to appeal to the U.S. Supreme Court.

We previously reported J&J’s loss in the 3rd Circuit Court of Appeals after a January 2023 ruling dismissed their bankruptcy legal maneuver to halt the cases of over 40,000 consumers who contracted cancer from using their asbestos-contaminated products due to their corporation not being in any genuine financial distress.

Rather than accept the Appeal Court’s ruling and allow the cases to resume, J&J requested a re-hearing of the matter. Nevertheless, in another legal blow to their strategy, the court unanimously rejected their request on March 22, 2023.

After the ruling, J&Js lawyers vowed to appeal the matter to the U.S. Supreme Court, a move which will likely further delay the resumption of the asbestos cancer victims’ cases.
